Bruyneel appeals to CAS to change dates of ban

Johan Bruyneel has appealed the timing of his suspension to the Court of Arbitration for Sport (CAS) asking for his ban to start on January 1 instead of February 1.

Why does Johan care? I thought the UCI initially may have given his the later start so he could attend TdU with Lance, since it would be LA's last non-American race. But now JB apparently prefers to be banned for Jan/Feb rather than Feb/March. Why would he care enough to pay a lawyer and take this to CAS just to get it moved by one month?

I thought it had been reported that JB said he wasn't going to be in the car for the 2011 races anyway. If that's so, it's not like he wants the ban moved so he can attend March races.

I'm kind of surprised the UCI didn't automatically accede to a Bruyneel request anyway.

Maybe he wants a good excuse to be well clear of Lance when the fan gets soiled.

From a management perspective, I'd think that a guy would want to be able to attend training camp when all of his employees are gathered in one place for the last time of the year. But two years ago he blew off every one of his other people at Santa Rosa so he could be with Lance at the wind tunnel and velodrome.

He managed to recruit the whole Radio Shack squad while he was being paid by Astana, so if it's true he won't be in the car, I don't know how much he's actually missing. If he's just not being paid for two months, there wouldn't seem to be an advantage. It's not like he won't be able to communicate. Unless it would make him miss some meeting of all pro team managers, it would really just keep him from races.

Maybe he found a nice vacation spot for January?

As the finest manager in Pro Cycling Johann has every right not to divulge his reasons and ask for his penalty whenever he likes. Standard practice for pro sportsmen.

I was just sayin' in the eyes of the OP perhaps it was a preemptive placement.:p

Yes it was. I was on the fence about where to put it, and thought it best to err on the side of caution. I'm just wondering why Johan suddenly wants to not be allowed to attend the TdU, which I'd expect to be a major Lance-fest seeing as it's a milestone race for him . . . which led me to wonder whether JB already expects that LA won't attend the TdU . . . which led to me to wondering why . . . which led to the federal investigation . . . which leads to the clinic.

So I was being cautious, just in case. But it's no skin off my back if the thread gets moved into the regular section. After all, maybe there's nothing behind Bruyneel's CAS move anyway. It just seems like a lot of trouble to hire a lawyer and go to CAS for such a small gain.

Nothing in this post is accurate or true.

A ban is a ban.
It's like he's trying to change the dates of his vacation, given to him by his employers.
If he can't be bothered dispute the duration, CAS shouldn't have to waste time on such trivia.

My only surprise is that he didn't ask for November 1st to January 1st, but maybe that was too much like taking the p*ss, even for him.

it is a bs ban, nothing to do with cycling, just a show by the tour organizers to show that they are in control.

If Johann does some bad tweeting or contacting the team would the ban be extended?

...and the UCI has the right to decide when his ban will take place. Bruyneel's argument that Barredo's ban is for a different period than his own doesn't take into consderation that the purpose of the ban is to punish. If the UCI decided that the period chosen has the greater effect on its recipient then so be it. Breaking the rules, accepting the length of the ban but having a problem with when the ban is is a typical control freak/above the law attitude that Bruyneel is known for. Take your ban like a man and move on.

...as opposed to Bruyneel being in control????

You break the rules you pay the costs. He is in no position to dispute their decision since he's already admitted the team was at fault, which was really big of him.

Exactly. This is like a cyclist that had been sanctioned asking the uci to start his ban in august so that he can still race the tour. He disobeyed the rules and is getting punished for it.
