But what is it that PHIL ZAJICEK is alleged to have done?

Allegedly appearing on Joe Papp's Super Shopper list.

Finally, we are allowed to mention he who must not be named :D

Talk about a badly kept secret.

My understanding is he was on the customer list for a certain website. That would point to there being purchasing records, either credit card records or delivery records that identify him.

Bye Bye Phil!

He's only making the headlines as Papp's trying to keep himself out of jail. According to the story he was aquitted at the hearing and Papp's the source.

Hes making headlines as many others have. There was a substantial list of riders who purchased EPO products from a certain website. Some have now been banned, some have quietly retired, Phil chose to appeal and fight the decision. All the time his name was covered up and the press kept quiet. Now that USADA may appeal his name is out in public domain.

Are you suggesting that cycling news have put up the article as a favour to joe, or to somehow sway the decision at any court case Joe may be involved in?

Good on CN for reporting it. In the past ive accused them of lacking balls, although arguable PZ is a bit of a nobody.

I feel so sorry for Phil's poor girlfriend. She must be very sick to have to order all those drugs. I hope she gets better.

Anemic apparently. Before the EPO she looked white as snow.

It would be interesting to see what his argument truly was. Is the girlfriend thing just a joke, or might there be some truth in that (being his excuse, not an actuality)? Sounds like an old-school strategy.

Is it safe to assume that this is Papp's statement?:

"I can confirm that the Zajicek case is being appealed," a source who is close to the case, told Cyclingnews. "They say they have a stronger case now. I provided USADA with information about him."

If so, I don't see why he wasn't more forthcoming about it to begin with.

He was acquitted because he opted for the "speedy trial" choice, and this hindered USADA's ability to transport his ex-girlfriend to testify against him.

That attorney in L.A. knows that USADA has a shiite budget and can't really afford to press hard on the cases. So the current strategy is to immediately ask for the hearing and "go for it"

So are ya gonna go for it?

Are you flipping serious? Wow. What a joke. Once again, I vote for a trial in the court of public opinion.

Too bad lying in a sporting court doesn't result in a longer sentence.... but at least there is double jeopardy, right?

Three riders whose last name begins with "Z" have been implicated in doping in the past year and a half or so. That may not seem like much, but as a % of all the riders out there whose last name begins with this letter, it is undoubtedly much higher than any other letter.

This can't be coincidence. I think USADA and other organizations are finally starting to work through a huge backlog of cases, and have decided to begin at the far end of the alphabet. This means that USADA has no intention of going after anyone whose last name begins with "A" for a long time. Fortunately, others are taking up the slack.

In related news, David Zabriskie changed his name to Aardvark.

The cyclingnews article is wrong when it says that USADA will appeal to the American Arbitration Association panel. That hearing already took place in September and Phil Z. was not found guilty (which is also not the same as being exonerated).

This appeal USADA has currently filed is with the CAS.

How so? Not guilty is not guilty AKA exonerated.

Courts never declare anyone innocent. They render an opinion of guilty or not-guilty.

Exoneration is akin to innocence. Irrelevant.

who is his girlfriend? does she race too?

I don't see why the USADA could not have called the girlfriend and asked her what she thought about Zajicek accusing her of ordering an illegal shipment of drugs. ;) I am sure her response would have been interesting.

Maybe I have the wrong case. Someone's ex-GF is the one who handed the evidence over to USADA in the first place. A recent case.
