The witness list is pretty impressive and under oath, where the stakes are overshadowing the € 5.6 million claim.

How likely is it that Leinders will tell lies under oath if asked did he run a doping program or was involved in doping riders?

Is Dutch justice as scary as the Feds or like the Italians where you lie till the SOL runs out.

Having spent like a lifetime in that court, it's the most liberal of the 6 Dutch high courts, closely aligned and purveyor to the Dutch Supreme Court, who are strict in following European consensus.
Scary no, but in this case workers rights and a (doping) fair trial will be pinnacle, cause Dutch judges on this level, can't afford to have their case move up to the next pigeonhole, without getting their ruling scrutinized.

Now is this bank popular ... well it's widely rated as arrogant, a nontransparent fortress, that survived the financial crisis with private aquity.

The bank had to pay Rasmussen € 700.000 the first time but appealed just as Rasmussen did demanding a payout of more then € 5 million.

Transcript out of the July 2008 verdict:

Rabobank certainly knew in advance that Rasmussen was not in Mexico.

Do you think Leinders will risk telling lies?

Nope, this (court) panel is dyed-in-the-wool, inquisitive, nosy and very vocal, bound to get to the truth,
that very well in this case suits chicken and land him a huge payout, as where the banks ways and means
will get exposed.

From the key players one harrowing catch-22.

Born 10 miles down the court house, bearing the name of the family attached to the Gazelle factory for almost a century and sold by the bank in 2011, Erik must have said to the bank he will cough it up and took the ramification.

24 april 2007 - Rasmussen e-mail to Breukink: "I prefer if we can keep this trip quite [spelling Rasmussen]. As I am supposed to be in Mexico at the time."

Mexico trip 4 to 12 June on the whereabout books.

6 juni 2007 - Erik Breukink meets Michael Rasmussen in a hotel in Bergamo. Breukink has declared the talking point was "who will lead the team in the upcoming TdF"

translation for broader readership. Interesting case. May be an opportunity to nail another one on the UCI coffin.

Witnesses declararion case Rasmussen mid November
Arnhem - On November 12 the Arnhem court will hear several witnesses in the appeal case of the Danish cyclist Michael Rasmussen and the Rabobank cycling team. Rasmussen is claiming damages of 5.8 million in a case that revolves around the dismissal of the Dane in the Tour de France of 2007.

After the appeal filed on 25 May counsel Knottnerus was initially going to rule on 7 August. The rider maintains that the team was aware from July 3 that he had lied to the UCI about his whereabouts before the Tour.
The cycling team says they did not know until 25 July 2007 that Rasmussen provided incorrect information about his whereabouts in June 2007, and that they received from the court the opportunity to confirm this via witnesses. This is going to happen on November 12.
Rasmussen already successfully fought his dismissal in 2008 and was awarded a compensation of over 700’000. This neither he nor the cycling team agreed with. A spokesman for the cycling team confirmed that at least two witnesses will be heard, but did not yet want to disclose names.

and also the belgian newspaper article

The Dutch cycling team Rabobank awaits with clenched buttocks the doping file on the Austrian blood bank Humanplasma. The Austrian Minister of Sports has decided to send the case to the responsible doping authorities , reports the Volkskrant. Former Rabobank rider and near Tour winner Michael Rasmussen has just announced to start talking about organized doping within the Dutch team.

The ball recently started rolling when the Austrian Bernhard Kohl confirmed that he was a customer at the Vienna blood bank. The climber was caught in the last Tour de France using cera, supplied by Human Plasma. Previously, also Michael Boogerd, Thomas Dekker and Denis Menchov have been associated with the affair. Rabobank has announced that several riders are contributing to the investigation voluntarily.

On Rasmussen blowing the gaff on doping - given the statute of limitations has not yet run down and the fact that he's still riding, I somehow find that hard to imagine.

media statement to build further negotiation power for the settlement?

FYI Verner Møller's The Scapegoat http://www.podiumcafe.com/2012/10/3/3448776/the-scapegoat-by-verner-mller and an interview with Møller http://www.podiumcafe.com/book-corner/2012/10/4/3453688/interview-verner-mller

On Rasmussen blowing the gaff on doping - given the statute of limitations has not yet run down and the fact that he's still riding, I somehow find that hard to imagine.

But Rasmussen has already served his suspension.
While his information could potentially broaden what is known I would doubt the Danish (Monaco?) fed would revisit it.

If he goes beyond the whereabouts violations for which he was punished + discusses doping you can bet on the UCI coming down on him. They do not want any more doors on the past being opened.

On the subject of open doors: How did the whereabouts issue "accidentally" get so public at such a "convenient" moment? It's a minor cause for concern now, but it was a way of avoiding extreme embarassment at the time... imagine how bad the UCI would look if MR had won the tour and it came out afterwards!

Thank goodness it was won clean that year, phew! :D

For one possible solution, read this http://www.podiumcafe.com/book-corner/2012/10/4/3453688/interview-verner-mller Appears it may have had little or nothing to do with the UCI's embarrassment and all to do with someone else's

If, on the other hand and as you suggest it was a UCI conspiracy, are you implying they also mixed up Vino + Kashechkin's blood bags? PMQ had already declared Vino unworthy, he having revealed he was working with Ferrari ...

I did say "so public" to imply that the UCI were not the original source of the leak but facilitated in spreading it.

However, that's a great link, thanks. Really takes you back the time. I'd almost forgotten just how tense the ASO UCI debacle had become.

It came about because Davide Cassani met Rasmussen in Italy in June training up in the Alps before the TdF. Cassani and Rasmussen had a chat.

During the TdF it was mentioned that Rasmussen trained in Mexico for the TdF. Cassani said on live tv while commentating on the TdF, RAI3, no that is wrong that he met him up in the Alps in June. It snowballed from that.

Hah, yeah Zam and that Levi betrayal thing about the bank in LAgate might land Rasmussen the big payout without even getting his day in court come november.

There's rather a lot more to in than that simplified version.

And Cassani's commentary came before Rasmussen claimed to have been in Mexico, so you've got what he said wrong.
