According to Marca, the court said it hadn't been established that he doped, so maybe they went solely by the strict liability rules. Or maybe it's a bit of Marca putting a bit of a spin and it's a matter of probabilities.

I reckon he should be able to ride in August 2013, not 2012, but Marca does say he could ride the Vuelta this year.

That would make more sense - no need to distort more results than necessary. Plus this way it means he's actually been racing through half of his ban.
