After today's news I'm left wondering if the RadioShack team will be allowed to start the TdF? I'm guessing the TdF will be without them this year, I mean with so many of their key personnel busy with legal woe's how can they manage to concentrate on the TdF? UCI needs to step up on this one.

I was thinking the same thing...and even if they start, besides all the drama they have gone through this year, and now LA and Bruyneel big bomb news, how can these guys not be stressed out or feel motivated to ride the Tour?

PS: Horner might not be missing anything after all.

Yes and No. Technically they should, on the other hand, some of the best riders are already not participating so leaving out Spartacus and the rest of the Shack team just because of the LA/Hog doping investigation would be disappointing ...

RSN of course will race tour, the team has little to do with USPS or Discovery, but JB as a person or sport director maybe will not be welcomed by Tour organizer, so it is quite possible Kim Anderson will unite with FS after all.:D

Well I can come up with a list of riders who's teams were banned and they then got the shaft so to speak and they were just as good. Don't see how riders now won't get that same shaft.

Did you read the USADA letter, I think there are still three on the current team. Who's FS?

Those three are not riders, furthermore USADA has no jurisdiction against non-American, just sent a team without Americans, LOL maybe that is the real reason of Horner non-selection.

So you're saying Ricco, Festina Team 1998, & other banned Euro's can race in the USA? Huummm... don't think so.

NO, what I am saying USADA can only ban Americans to participate races, like Armstrong, Horner, Hincapie, as a mater of fact Armstrong is banned immediately from today. But USADA can't ban Andy Scheleck, Jakob fuglsang, simply because they are not Americans.

USADA is only a national organization, it simply doesn't have juridification against people of other nations.

So now you're saying if some European national cycling body issues a major doping case on the same European nation's registered team's Ex star, DS, and current and past doctors they can race in the USA or other country other than that European nation.

Again, don't think so.

What you are missing is if the UCI (and ASO) actually read what is happening they will not allow the team to race because so much is hanging on this. If you recall there have been teams left out of the Tour just because the year before that specific team had a few infractions, not to mention because less than desired riders were on those teams. Now you think just because the current RadioShack riders were not on the team (well most of them) during the issued case they will be allowed to race even though the DS and Doc's are the same in the case.

No I am not missing anything, you just don't get my drift. Banning has no region requirement, if USADA banned american rider, banning is worldwide, this American can't race anywhere. But USADA only have authority to ban Americans but no other nationalities. Understand?

And yes USADA can pass information or evidences to other national agency or WADA, weather the other national agency or WADA take action or not is none of the business of USADA. USADA simply don't have jurisdiction against people of other countries. God I am repeating this like crazy.

And USADA have authority over american soil, even if a rider from another country is not banned by that country anti-doping agency or WADA, but USADA can ban that rider participate races held on American soil.

So strictly legally speaking, USADA can't ban JB go to Tour. But weather tour organizer will welcome JB or WADA Belgium anti-doping agency take action against JB is another story, tour organizer can simply tell JB you are not welcomed here because of too much negative news, end of story and situation like this happened before. That is why I am saying FS will unite with Kim Anderson after all.

USADA may not have power to do something but that's really irrelevant because it's really up to ASO whether they are happy to have on board a team run by someone who along with his current staff are under investigation for conspiring to stuff up their race for about a 10 year period.

Quite what their strategy will be is going to be interesting to say the least.
 
Surely JB needs a licence to be a team manager, delivered by the UCI diretcly possibly? Can they turn a blind eye? If not ASO will certainly be more than happy to make him a "persona non grata" on the TDF. Can't wait for Horner to tweet about that ;-)

Not quite. USADA have authority to ban any athlete with a US licence, regardless of nationality. The Swiss federation opened a case against German national Jan Ullrich on these grounds.

The Italian and French anti-doping agencies even have banned foreign nationals with foreign licences (Valverde and Landis) from competing.

Makes sense though now that Andy won't ride. If Andy would ride than I'm sure they wouldn't even consider it.

This is quite interesting, because technically, Bruyneel is just a consultant for the current Luxembourg based team, right? He is not a DS and need to apply for a special permit to be in one of the cars. The logical thing to do would be to fire the consultant and ban him personally from the tour, not the team hiring the consultant.

For just a "consultant" he's certainly been the team's primary spokesman to the media and the one who appears to be be making many of the major decisions. It's not as if there is someone who asks him for his expertise on particular matters and then makes their own decision. It's Bruyneel in charge and RSNT haven't been trying to cover it up at all.

I know that he's been in charge of the team but on paper he's not. He was left out of the UCI application. I don't know anything about the contract between ASO and UCI, but to me they shouldn't be able to ban the whole team because according to UCI Bruyneel isn't the boss. It's a very different team from USPS/DC. Is it three out of 40 staff members of RSNT who has been charged? Not many at all.

But having a consultant as general manager is extremly weird. Hopefully they just leave Bruyneel at home and sack him if eventually convicted.
