CMS Doping in sport revelations/discussion

There was an MPTS press release the other week:

‘We continue to liaise with both the GMC [General Medical Council] and Dr. Freeman’s legal representatives about their preparations for the case, and remain in close contact with parties as part of the ongoing case management process’, wrote an MPTS spokesperson in an email. ‘We do not confirm hearing dates until a notice of hearing has been issued to the doctor. This usually takes place no later than 28 days before the start of the hearing.’

Looking at MPTS's 150 odd hearings so far this year, the following 7 hearings are all in similar state to Freeman's so not unusual.

Not sure about that. It's just a timely process. 6 months is not unusual for new dates to be set. Freeman's was only adjourned to a new tribunal 3 months ago. e.g

It's a GMC hearing, not an anti-doping hearing. What 'system' do you think this is a part of?

Why on earth do you think a GMC which is bothering to charge Freeman would be keen to acquit him?
 
Before anyone gets too excited, thanks to that laptop robbery the GMC has little way of tying it to a specific rider. Plus the Statue of limitations has expired based on this case related to clenbutarol from the 2008 Olympics

Seems like they have no evidence at all that the delivery was intended for a rider. Sutton is denying all knowledge of the delivery whilst Freeman says the Testogel was to be used by Sutton himself.
 
The former British Cycling and Team Sky doctor Richard Freeman will admit to telling “a lot of lies” and ordering the banned supplement testosterone, an independent medical tribunal heard on Tuesday.
 
It's not actually prohibited for a Doctor to order prohibited substances and store them unless intended for an athlete for doping. Remember they function as an on the road GP, so have to store and have access to prohibited medication for injury, ooc, TUE, prescription, emergency etc. Not forgetting there's over 60 staff and riders and staff families etc on the road at a 3 week race all being treated by the Team doctor too who will be their GP no different to large companies that have on-site GP you visit at work. WADA code clearly allows for that. Obviously this is why the entire case for GMC is focused on a staff/rider. If it was against the rules to order it and store it, UKAD can already charge Freeman anyway using WADA code and Peters & Burts witness statements Freeman would have to prove as false.

At the moment, they have Shane Sutton in the building and their entire case appears to rest on proving Shane Sutton didn't need a months course of 30 Testogel to get an erection and he didn't ask Freeman to order it for him. It's hardly looking likely, GMC will have anything to hand back to UKAD if that is their strongest hand. They might be playing a weird game of holding back all this evidence of a rider, but it would seem it rests with Sutton and if Sutton denies everything the burden of proof will be entirely on GMC to find evidence of what they are claiming has happened. If Sutton denies, GMC can't even claim Freeman broke any GMC rules either, because they won't even have a statement Freeman administered anything to anyone - rider or staff then.

Sam - Read through the Wada code - An athlete support person must not have banned substances at their workplace for athletes who compete under the WADA Code - There has been at least one case in which an athlete support person has been sanctioned - Read Stephen Dank.

It does seem a bit odd to me that they would throw Sutton into the equation, someone with a relatively (within the cycling world) high public profile and prone to speaking his mind.....wouldn't it have been a safer bet to just say it was for some random backroom staff member, or even a relative of a random backroom staff member and then hide behind the whole medical confidentiality thing.....
