The criminal complaint was filed in Vevey, Switzerland today by Kimmage's attorneys on behalf of both Kimmage and his fellow "whistle-blowers Stephen Swart, Frankie Andreu, Floyd Landis, Christophe Bassons, Nicolas Aubier, Gilles Delion, Graham Obree and the many others - who were brave enough to speak but were dismissed as 'liars', 'cowards', or 'scumbags' by Hein Verbruggen and/or Pat McQuaid."
Can anybody clarify to what extent the persons named are involved in Kimmage's complaint? Did they merely grant Kimmage's lawyer the right to name them or did they co-sign the complaint?

"In addition, Paul Kimmage informs the Swiss criminal authorities of the strong suspicions which weigh on at least Hein Vebruggen to have granted, directly or indirectly, the essential assistance which allowed Lance Armstrong to gain significant sums of money in and out of competition while he was doped."

This has to be the most courageous move by anyone in the sport in decades.

Forget your stage wins, GT wins, Monument wins etc this eclipses them all.

That´s the question...

Kimmage must be crazy, he has the wrong advisors apparently. His lawyer says "Sue!", wants to make money, his friends say "Sue" to have public attention, but no chance for Kimmage against the legal and financial power of UCI.
Now 85.000 is rather low, hope he won´t be ruined.

This is the biggest thing ever. Looks like Verdruggem and Pat done picked on the wrong dude. And I trust he will have the full help of Novitsky, to boot.

Paul Kimmage
My lawyer, Cedric Aguet, works for Bonnard Lawson in Geneva. I call him Maximus. He has just unleashed hell.

I have lodged a criminal complaint against Hein Verbruggen and Pat McQuaid. I have initiated these proceedings not for myself - this is...
...not about Paul Kimmage, but on behalf of the whistle blowers - Stephen Swart, Frankie Andreu, Floyd Landis, Christophe Bassons...
...Nicolas Aubier, Gilles Delion, Graeme Obree and every other cyclist who stood up for truth and the sport they loved and were dismissed...
...as "cowards" and "scumbags" by Verbruggen and McQuaid.

Strongly disagree. Kimmage has the support of thousands, including some of the most influential names in the sport. Kimmage has the support of the press, because he is one of them. And Kimmage has something else: evidence. I'd rather be Kimmage right now.

Kimmage has what the UCI doesn't - which is the truth.

the current score of the kimmage fund is full of irony.
wasn't 85.000 exactly what UCI paid for the sysmex?

of course I hope it rises further though.

I think this case Kimmage ./. UCI will lead to nothing, he can´t be successful, UCI are not stupid, they likely have done everything in the past to make sure there is no evidence for anything. In court, evidence is what is needed, and Kimmage doesn´t have more than speculation, hearsays and so on.

OK, it rises pressure on "McVerbruggen", but if they stand together, and UCI commitees do so, Kimmage won´t influence UCI internal things.

Hahahaha! Where does it say he's suing the UCI? He's suing McQuaid and Verbruggen personally. That means they can't use UCI funds to defend themselves, they have to use their own money.

Some of the evidence is public record. Statements by Verdruggen for example. Those taken alone are a damning tale of corruption. Someone just needs to put it all together and go after them... and follow the money. This will be good.

I made a small donation when the defense fund was first announced, but I'm going to make another one now. This is exactly how I wanted to see my donation being spent!

Plenty of hard evidence that Verbruggen knew Armstrong was doping. Plenty of hard evidence that when Verbruggen called Andreu et al. liars, Verbruggen knew he was committing criminal libel. And if you think the USADA decision was speculation and hearsay, I can only say "I'm sorry. Sorry you can't believe in miracles.":D

His legal team is working pro bono. He'll be using the 85k+ for costs - flying in witnesses etc.

And just to make it sweeter.
Kimmage was being sued by the mob in Switzerland - as an Irish resident it counted for little, but as the old boys live and work in Switzerland this could really hurt.

Nice counter-attack.

I think this may already be the best clinic thread ever.
