Kimmage unleashes hell, counter-sues Verbruggen & McQuaid

The full press statement is as follows:

Lausanne, 1.11.2012

By this release, the undersigned makes the public announcement that his client Paul Kimmage has sent today to the Public Prosecutor of Vevey a criminal complaint and denunciation against Hein Vebruggen, Pat McQuaid and unknown persons against whom Paul Kimmage requests the opening of a criminal investigation for slander/defamation, denigration and for strong suspicions of fraud.

By this 28 page document to which 55 exhibits are attached, Paul Kimmage complains, among other things, thtat he was dragged through the mud, that he was called a liar in public and accused in public of committing offences against the honour after he had obtained the publication of an interview by Floyd Landis in which the latter denounced the conduct of the highest officials of the International Cycling Union (UCI). In addition, Paul Kimmage informs the Swiss criminal authorities of the strong suspicions which weigh on at least Hein Vebruggen to have granted, directly or indirectly, the essential assistance which allowed Lance Armstrong to gain significant sums of money in and out of competition while he was doped.

Paul Kimmage has initiated these criminal proceedings not for himself but first of all in honour of the whistle-blowers – Stephen Swart, Frankie Andreu, Floyd Landis, Christophe Bassons, Nicolas Aubier, Giles Delion, Graham Obree and the many others – who were brave enough to speak but were dismissed as ‘liars’, ‘cowards,’ or ‘scumbags’ by Hein Verbruggen and/or Pat McQuaid.

Perhaps the thread title should be changed?

Kimmage is not suing. He is as far as I understand presenting the police with a tonne of evidence and filing a criminal complaint.

The police will then need to evaluate the evidence, then investigate, then prosecute.

So in effect Kimmage's lawyer is calling the cops on the Pat and Hein.



So the question is how long it takes before the police raids their respective houses and offices to gather evidence.


Since the judgment against Landis made clear that they were not to be compared to terrorists or Gadaffi, perhaps they actually can compare?

And Gadaffi had a habit of spreading weapons around his embassies.

I think the Swiss police should be careful.

Well, in his open letter, he did say about having some evidence of some sort.

CyclingNews got it wrong in claiming Kimmage was "countersuing" in defense of UCI/Verbruggen/McQuaid defamation action.

Velonation got it right by informing Kimmage "counter attacks" by laying information with authorities alleging criminal conduct.

Was that the thread announcing that Pat and Hein were suing Kimmage? When did the deletion happen? What was the reason given?

EDIT: What was in that thread? Why don't we list in this thread all those things that were in the other thread that might have gotten it deleted. Merely as a point of fact. :D

This is even better than counter-suing, IMO - a lot cheaper, for sure, and a lot more likely to turn up something (assuming the Swiss police do their jobs and aren't corrupt).

Isn't this way more serious in it's implications than a mere suing for defamation? If there's a ton of evidence of serious criminality then they'll be off to jail.

it was over 70 pages, i think. too many to recoup.

Dan thinks it may have been deleted by mistake because the originator of the thread wished his account deleted... hopefully, fingers-crossed, it can be resurrected.

This is Hein and Pat we're talking about, so we are talking epic corruption that I doubt they can fully sanitize. We're also talking about some of the most effective terrorists in sport. What kind of human shield they will put up?

The shredders will be working overtime tonight for sure. Time to buy a couple of new computers too.

Maybe the secret that binds Armstrong to Hein and Pat will finally be told.. Hello Thom Wiesel? Anyone there?

I hate to be the party pooper here, but this could prove to be a mistake. UCI could instantly re-activate their suit against Kimmage here and outspend him 100 to 1. And then outspend him to defend his counter.
Paul, if you are reading this please stay centered here and do not let the euphoria of the moment guide you into a false sense of advantage. The 80 K will disappear faster than a Jamaican pickpocket, and the goodwill of the believers can only carry this so far. Let the battle be fought by the ones who can afford to. Please.

How much does it cost the good guys to lay information before authorities? Next to zilch.

How much will it cost Kimmage et al to use Swiss authorities to investigate and prosecute? Zero.

UCI claim to be impoverished. Will need to go to UCI congress to plead for additional funding to prosecute the Kimmage "war".

The UCI suit against Kimmage is proving more day by day to be a no brainer and has turned around and bitten Hein & Pat on their derrières. The original script called for Kimmage to not contest.

His lawyers are working Pro Bono. The 80k is being spent on flying witnesses, requesting documentation etc.

Also this is not civil trial with several appeals. Its a submission to the criminal court. Its not Kimmidge vs UCI.

First Kimmage is going after HV & PMcQ personally. No UCI funds will be used (wasted) trying to defend themselves.
Effectively, this is now in the hands of the Swiss authorities to pursue.

Regardless, the UCI does not have major funds - but I would think the 2 old boys have enough stacked away (thanks Nike) but if PK needs more funds I expect he can get way more.

If Hein and Pat had their way, the UCI would blow what meager revenues it has on grinding Kimmage into financial oblivion. The good news here is the UCI's Management Committee put and end to that. They know better. *I* know better and I'm a nobody!

I don't doubt for a minute Terrorists Pat and Hein could finance the legal battle on their own, but the endless supply of "It's on me!" money for legal bills would raise more questions than crush Kimmage.

There's the matter of Hein and Pat's permanent defense of Armstrong that may come to light. Hopefully, criminal charges appear in the months ahead in the U.S. and Swizterland and the IOC stays out of it.
