You're probably not doing enough homework, given the omission of any form of intelligence in that post. Better hit the books harder.

From my limited reading I think Lemond is entirely in the right and doing some good justice for our sport. Looks like Armstrong's very thin skin might do some damage to him this time...I am so looking forward to the *** beating Contrador is going to give him next tour as well...

So he is admiting that he has rejoined many times after being banned, which is against forum rules, and yet he is still here.

sure it's not the other way round? i've googled "the arbiter" now, what an inspiration for a name. according to wiki it is a disgraced commander in some computer game :p

well anyhoo, perhaps this clever finding by the huge one means we've gone full circle. it's all over people, he's dead for good now

It is not my interpretation of the evidence, it is the judge's. He tossed out large portions of Trek's case yesterday and questioned the rest. The judge also noted in a footnote regarding Trek's sole surviving claim that the court had "reservations" regarding its "viability" and invited LeMond's attorneys to file a motion knocking it out as a matter of law when the record is more developed at trial.

He also footnoted that one of Trek's quotations regarding the law on best efforts was "misleading." What a surprise, Trek tried to mislead a federal judge......not smart.

If you take issue with his interpretation of the evidence then I suggestion you take it up with him. I am sure he will be as eager to hear your opinion as the rest of us are.

And yet, as reported in the NY Daily News on Friday, December 4, the judge wrote "A jury could reasonably infer, depending on how the evidence unfolds at trial, that the LeMond brand's lack of growth was caused by LeMond's statements," Kyle wrote, adding that "there is a genuine issue of material fact as to whether LeMond's commentary actually caused damage to Trek."

Additionally, the article reported that "The trial would presumably focus sales figures as well as e-mails from consumers and bike dealers reacting to LeMond's comments. Earlier this week, another judge issued a ruling authenticating such documents, which LeMond had challenged. U.S. Magistrate Judge Janie Mayeron pointed out that LeMond had used the same documents in support of his own arguments."

This confirms what I posted I wrote that the judge was letting the Moral Turpitude claim go to trial while tossing out most of Trek's case. You might have missed this part of the article that refers to the discovery that Armstrong had been using the sports most notorious doping doctor who at the time was on trial for his actions.

The controversial comments that LeMond made now seem fairly benign.

"If Lance is clean, it is the greatest comeback in the history of sports," LeMond told the Sunday Times of London in 2001. "If he isn't, it would be the greatest fraud."

The judge has already questioned Trek asking if Greg's comments would have been harmful if Armstrong was in fact a doper, thus opening the door to the huge amount of evidence that he is. How is Greg damaging the Trek brand if what he says about Armstrong is not only true but widely believed by cycling fans?

The emails and dealer testimonies cuts both ways. Trek told some dealers and distributors that they would not be supporting the Lemond brand, despite having years to go on the agreement. Trek was forced to give up thousands of emails that they initially denied existed. Don't be surprised if these emails detail Trek's efforts to kill the Lemond brand and show that Trek did far more damage to the Lemond brand then any of Greg's weak comments did.

Thanks for posting this information. There's always more than one side to every story.

Race Radio, is there a link to yesterday's proceedings that you refer to? I would love to follow this a bit more closely.

And I would LOVE (!!!!) to see the circus of Armstrong in court trying to prove himself clean. Oooo this is going to be very entertaining!!:D

I hope you weren't holding your breath waiting for that link.

As I wrote my source is the court document, not a newspaper article. You are free to get an account with the US District Court’s Electronic Case Filing system and give us your interpretation. I think it is 3 cents a page.

Moral turpitude

Moral turpitude usually can come into play during Adultery or Extortion cases.

Not sure what that has to do with this case...

The trial would presumably focus sales figures as well as e-mails from consumers and bike dealers reacting to LeMond's comments. Earlier this week, another judge issued a ruling authenticating such documents, which LeMond had challenged. U.S. Magistrate Judge Janie Mayeron pointed out that LeMond had used the same documents in support of his own arguments.

Wait. Lemond was challenging the documents he is using in his own case?

No wonder Trek is so eager to settle the case. haha
