You can, but if you do your testimony probably won't be allowed, and the finder of fact will probably be allowed to draw adverse inferences from your silence.

Taking the 5th in a civil case only makes sense if you genuinely fear that your testimony in the civil case will expose you to a real risk of criminal prosecution.

The deposition was closed to the press and public, and while SCA president Bob Hamman said he could confirm that deposition took place, he said he was barred from discussing specifics.

"His public confession didn't hurt us any," Hamman said.

Perhaps the SCA man will be arrested for being so thick? :rolleyes:

Good times.

Maybe some traction to follow or a settlement. Probably just more appeals.... well appealing will be obvious.

Does this mean that Tillotson gets a second chance at pronouncing Frankie Andreu's name correctly?

I've always assumed that this entire thing was orchestrated by Betsy, behind-the-scenes, for just that purpose. :cool:

Meanwhile in the Federal case....

The judge in a whistle-blower lawsuit accusing Lance Armstrong of defrauding the government by using banned substances in violation of his team’s contract with the U.S. Postal Service put on hold a deposition of the disgraced cyclist.

Judge Robert Wilkins in Washington said he expects to rule within a week on a request by Armstrong to dismiss the lawsuit, originally brought by former teammate Floyd Landis in June 2010. The case was joined in part by the Justice Department in February 2013.

Wilkins said in November that he was inclined to let at least some of the lawsuit go forward. He told the parties to meet within 20 days after his ruling to propose a schedule, according to an order he issued this afternoon. A June 23 deposition in which Armstrong would be asked questions under oath by opposing lawyers could be reset if the case proceeds.
