Velonews article updated - "disposed" has been changed to "deposed" - possibly Mr. Tan reads the Clinic.

Interesting to note that his statement "I have seen and read testimony..." has not been changed.

There should be silence. It is what is appropriate in *any* case where the accused is not convicted.

Regardless of how loathsome we may find Armstrong's behavior, we shouldn't allow it to push us to violate the entire basis of our criminal justice system.

If you have seen and read "testimony" from the Federal Grand Jury then you must be privy to the transcripts. Testimony is evidence, oral or written given under oath.

If you were in the Grand Jury room you would have heard testimony.

None of the above could be possible because of the secrecy of GJ proceedings.

However, if a GJ witness outside the GJ room informed the media of the evidence they gave and this was included in a written article this would be a "seeing and reading" of the witness' account of the evidence given but, as not under oath, not the testimony.

Totally agreed except for "should not be possible" in place of your "could not be possible". Never rule anything out.

Mr. Tan did not say he was seeing and reading a witness account - he stated that he was disputing Betsy's statement regarding leaks because he had seen and read testimony.

I think more clarification from Mr. Tan is needed. Then again, it would not surprise me if the article was re-revised to exclude his statements about testimony. I do not think he realized what pot of hot water he was diving into.

I'm with you. No way we want violate the criminal justice system. That would be terrible. Imagine that. Like it would he so bad if the justice system was violated by a bunch of cyclists riding in some race year ago in Europe.

Grand Jury Testimony is sealed. Even in Armstrong's complaint he sited nothing that could be traced to a Grand Jury leak. If Tan did indeed read leaked testimony it is a huge deal. Troy Ellerman was sentenced to 2 1/2 years in prison for leaking the Grand Jury transcripts in the BALCO case.

There is nothing to support Tan's claim, and he offers nothing to support it. With such a huge claim evidence would be good. I call FOS

Asking for clarification is something I have also done. It would be interesting to see some. Still puzzled on why he is "wrong".

Also, did you find the link regarding the FBI announcing there were no leaks? That would be helpful also.

Read the thing: "Overwhelming evidence... appearance of tacit collusion . . . appearance of impropriety. . ." all in an attempt to pressure the United States into taking action against Lance Armstrong.

I agree, it is puzzling that Tan would make a claim and make no attempt to support it.
