I can still see Armstrong refusing arbitration and going for victim status in order to keep the evidence from being aired. Unless he figures that the truth will come out anyway and he may as well take his chances with arbitration and hope for a technical error.

Either way he appeares to be seriously up the proverbial merde creek.

Edit: But some here were saying Sparks took his time ruling, asking the parties to submit more information from Aug 10-17, because he wanted to make sure his ruling was correct and unlikely to be overruled. Why then was there no support with the ruling? Is this the normal way dismissals are presented? Just a couple of sentences, no reasons or justifications for the ruling?


Review my exchange with Python about Judge Sparks' ability to do mischief.

The judge gets a measure of deference when he makes discretionary calls. This decision involves no discretion. It is just a plain matter of applying undisputed facts to the law. The Court of Appeals will look at this completely fresh (de novo), so anything extra the judge writes is just fluff.

Edit: You must be looking at the order itself. The memorandum opinion is rather long (lots of fluff :)).

From the Cycling News article:

Armstrong now has until August 23 to either accept a lifetime ban and the loss of all results during the period of USADA's claims, which encompass most of his professional career including his Tour de France victories, or take the case to arbitration where all witness testimony and other evidence will be aired publicly.

He should be preparing for a managed admission based around "We were all doing it; it was just part of the game. Anyway, I’m done with cycling; now let's focus on the future and keeping up our great work with cancer sufferers". Don’t take it to arbitration and accept USADA’s sanctions. JV's admission, and potentially even Tyler's book, is timely and useful to this strategy. Get Phil and Paul on board to spread the message to the ignorant masses. With some careful PR he may be able to retain enough of the faithful to ensure $ making ability.

Now, whether he has the sense or capability to do the above is another story.

At what point do the real masterminds behind this fraud (Weisel) take the reins and tell him what to do?

I'm a bit surprised there isn't more jubilation here. I'm having a good jubilate :D

I particularly liked this bit:

Le sigh. Plenty of precedent to just * the entries and be done with it. Noone here or in the real world cares who ends up with "jerseys", USADA are simply trying to make sure it's safe for the kids.

I think he will do nothing. He will disregard any USADA sanction because he will claim the UCI is 'his' governing body. UCI will do the same. He will be totally non-responsive to USADA.
Then, he gets to stand behind this position with full support of McQuaid, holding hands in public like long lost lovers .
Pretty sure there will never be even a 'nuanced' admission a la Vaughters until his op-ed. He has to be pretty miserable right now, and still has to write the cheques to the lawyers which is most assuredly an anguish tough to describe....

If I were Pat i'd want Lance to accept the charges and prevent a public hearing, saving the UCI. If we dont have a public hearing, Tyler will make heaps from his book sales. If Lance accepts the charges can USADA make their evidence public?
