Well, we know the timeline of EPO tests and why those samples were "clean", but the general public doesn't so it's likely this will make some of them think the samples were manipulated by the evil French. For a while, at least.

edit: You might think this isn't too spectacular of Fab, but regardless of what Armstrong believes, miracles don't exist. Fabiani can't do much when most of what's being said is the widely known truth.

Armstrong has clearly lost control of the media, after browsing this article I came away with the impression that he is a doping liar and not the cancer fighter he likes to portray himself as. He must be some pssed off.

Considering his PR's guys rhetoric, it seemed like a doomed strategy from the 1st day. This guy spends his days extolling on how all of this is a waste of taxpayer dollars (as if that tactic ever got the feds off anyone's back before).

i thought this guy is paid for what he can 'pull' behind the scenes rather what he spouts in public.

he is probably working hard though whatever contacts he has to get leaks of what Novitsky has, put pressure on the feds to try and direct the investigation away from Uniballer and onto others etc....well it better be that or he is on big bucks for no bang

The French predispostion to disclosing details on Lance might be a better source although they may be motivated, as Flicker would say; by a stronger than usual dose of "hate" for his Lord Armstrong. Hard to spin this one even at $30k a month.

As part of her plea deal on check fraud charges and perjury Marion Jones had to also accept a 2 year sanction from WADA and hand back her medals......even though she Never tested positive (Sound familiar?)

Yes, but this underscores the trap Fabiani is getting into. By emphasizing (falsely) that the '99 samples were clean, he is in effect admitting that whether or not they were clean matters. If--as some Armstrong supporters insist (and as those who use the "waste of taxpayers's money" argument imply)--the question of whether or not LA doped is irrelevant to fraud, trafficking, etc., why even address the question of whether or not the samples were clean? Why comment at all?

By addressing the question, Fabiani is in effect saying that whether or not LA doped by itself is important. So if those samples should retest, and be shown to be positive, Fabiani will have more difficulty in brushing that off as irrelevant to the case. It might in fact be irrelevant, it's still a long way from proving a positive to proving fraud, but Fabiani has now set up the public to react to any possible positive as a bombshell. When your lawyer publicly insists that you didn't do something, and is later proved wrong, that damages your case even if what you did do by itself is not criminal.

Not sure what you’re saying but the issue of doping is the foundation to fraud.

For example: Armstrong dopes, pays sporting bodies to cover positive and/or to know what tests will be conducted. Armstrong wins races, collects winnings, collects larger insurance payouts, collects sponsorship deals, gets paid salary from federal money. Maybe Armstrong even bet on himself to win? More money.

Easy pickings knowing you can’t test positive and you’re probably going to win no matter what. Ullrich never stood a chance.

Ulrich must have paid off the testers as well because he never tested positive. Pantani too. In fact there are a whole set of highly suspected dopers who never tested positive, so this corruption must go far and wide.

Ulrich tested positive for amphetamine in a surprise, out of competition test.

Unlike Armstrong he was not given advanced notice of surprise tests so he had to sit out a 6 month suspension.
