If you believe the CN report, it's a different US Attorney leading the Floyd GJ investigation (Southern District of California, San Diego). There's no good reason why it would take four years to investigate Floyd for fraud--everything was knowable since 5/2010. Maybe the Feds (in LA under Birotte) did get mad at Floyd for not being honest with them, and transferred the case to San Diego to avoid any possible appearance of fairness issues. This fits with your theory.

The five year federal wire fraud SOL runs 5 years after the FFF stopped taking money. I expect that if we see anything, we'll see it before then.

Still, I wonder how reliable CN's source or sources were on this story. It is tough to buy that the feds are investigating Floyd, the whistleblower, after all this time.

So the Feds signed an immunity deal with Floyd, he tells the everything, then they go after him after Borat drops the case? Hardly

Fanboy, century riding, prosecutor in Fabiani's home town does his hero a favor. It will all backfire, but can't stop now. The cat is out of the bag. Waste of taxpayer money

The Borat Conspiracy is revived! Blame it all on the Kazakh!

MarkW thanks for the sincerity. I have to say I agree with you. Not a lot of it adds up or makes any sense at all. What ever happened to Government for the people by the people?

Investigations should only ever be conducted with the view to bring about charges and prosecution. If this is a fishing expedition or to somehow apply pressure or tie up Floyd I think the general public would feel aggrieved and let down by the Government. This why like you I'm not sure its true.

If like RaceRadio says that the Master of diasaster is behind it and applying some of his political muscle his then I think a lot of us would loose faith in the system all together.

Lance says he's moved on so I don't think he would have anything to do with it.... plus he has his triathlon and foundation to prioritise.

If Floyd wanted to hide from the Feds where would be the last place they would look? Yellow Rose or Mellow Johnnys?

This whole thing is silly. Can't nail him for fraud so what is the silliest thing they can think of to charge him with?

Smear two birds with one stone

Any bombshell with Floyd will inextricably affix itself to Armstrong as well.

So how many decades will Floyd spend in prison?

I say 0, no fraud, no felonies, no time......but we will have yet another example of Wonderboy's petty, vindictive behavior.

Armstrong's petty, vindictive behavior knows no bounds. I'm still angry at him for starting World War II, cancelling the Star Trek TV series, and keeping disc brakes out of the pro peloton.

But Armstrong's most diabolically evil move was when he made Floyd dope for Phonak, forced him to attack Lemond in a most hurtful way, then coerced him to create the Floyd Fairness Fund.

Hi mark,
I must admit I thought Armstrong would just fade away, but since you are back on the clock after your brief retirement it seems that it has not yet run its course.

So, could you use your Google law degree to come up with some actual charges that Floyd should face, because taking money from stupid people may not be nice, but it's not illegal thankfully (hey Facebook, I'm over here)

So under what circumstances would a prosecutor take a case unless it was indeed by someones petty, vindictive behavior.

Security breech, security breech! The perimeters have been comprised.

All interns report to the main board room immediately! I repeat all interns report to the main boardroom immediately.

Initiate smear campaign. Initiate cache-cache depth charge – stop subject from entering bathroom. I repeat stop subject from ordering escargot with cream sauce.

How did Armstrong coerce Floyd to create the FFF? Torture? Blackmail? Drugs? Federal Intervention? The fiendish tentacles of Armstrong must know no bounds!

I'm not in the club that thinks it likely that Floyd will face charges.

So if an eminent internet lawyer like yourself can see the futility in this then why would a DA take a case unless it was "vindictive and petty"?

Agreed. A co-Conspirator at the least

A far more interesting question is what motivates Phil to waste taxpayer funds on such a silly case?

I've never said charges against Floyd would be futile. I've never said that the US Attorney would seek indictment of a futile, or bad, case--in fact I've said the very opposite several times. If the feds go after Floyd, then Floyd is doomed. But there is no way they'll go after Floyd, the whistleblower, with a weak case after all this time.

The feds didn't go after Lance because they thought they didn't have a strong enough case. They're certainly not going to go after Floyd with a weak case.

So you're essentially asking the question: Why would the feds do something that they are never going to do unless it is vindictive and petty?

I'm not going into the Maserati Vortex on that one!

Hi Mark,
It would be much easier for everyone if you made clear what you say rather than writing long posts about what did not say.

So, for the sake of clarity, what charges will Floyd face?
Once I know that, then we can debate if they are indeed futile. Thanks.

It’s in interesting suggestion and one Mr. Armstrong will have to explain if this investigation would go to trial.

The countless phone records in particular the one phone call made 5 minutes and 26 seconds after Mr. Landis left his first press conference after testing positive. The email exchanges might also make interesting reading for some. All this especially after there had been little contact since Landis left USPS. Why was Mr. Armstrong so interested now?

Mr. Armstrong would also have to explain in detail that he never doped, never encouraged doping when Mr. Landis had joined the team and was introduced to Armstrong as "the boss".

Armstrong also made several press statements to the effect that CAS hearing was “unfair” and it wasn’t proven that he took testosterone “beyond reasonable doubt”.

A link could easily be drawn that Mr. Armstrong was keen for Mr. Landis to protect the “franchise”. An admission of any kind from Landis could bring the cards tumbling down on Mr. Armstrong.

I think proving coercion would be the one of the easier points to establish.

Should be fun.

I am not a member of the club that thinks it likely that Floyd will face charges, so I am not able to give you an opinion of "what charges Floyd will face."

Your position is clear: It is not a crime to take money from stupid people. I disagree. Stupid people are victims of fraud all the time. If I persuade a gullible person to give me money because I am the long lost King of Ruritania and I deserve to live like a king, then I should be on my way to prison for fraud.
