Second offence? Did I miss an earlier sanction against Frank.

His connections with Fuentes were cleared by ALAD before (I guess he had legitimate reasons to pay a doping doctor), so no sanction in 2008.

They can't ignore that this time around. His dad has fallen out with Pat too.

If he was cleared by them first time round it cannot be considered this time. That would be no different to counting an acquittal and two convictions as three strikes.

I can see this being timed out by the Luxembourg ADA and Franck being back racing with no sanction.

Doesn't mean he wasn't doped IMO.

Yes that would be unconstitutional I think ... once you have been acquitted for something you cannot be charged with it again IINM.

If he was legally declared innocent last time (which I believe he was) then it cannot play a role in the decision making this time

Ya Think!? The Grand-Duche de Luxembourg has a population around 500K, AND its very own Luxembourg Anti Doping Agency. How many athletes? Those guys at the ADA must be swamped with doing cases. No wonder it takes them so long to protect... oops... investigate Frankie's case.

Let's get real. Does the Grand-Duche need its own anti doping agency? What about Monaco, or Andora? Might as well have one on the Falkland Islands.

Are there really enough anti-doping experts to go around? Looks like a colossal waste of money to me. I live in a small town, and in most cases the job of the police is to protect the locals FROM the law. Someone driving drunk... stopped by his brother-in-law or cousin the police officer... "You're drunk Ted, I better give you a ride home. How are Billy and Susie? See you in church Sunday." Is the cop going to bust Ted and then be shunned at the 1) family reunion, 2) Christmas at Grandma's house 3) The lion's Club chicken dinner... etc etc etc.?

Do away with these meaningless Local Agencies and have the countries put the same money into some umbrella agency, WADA, or whatever. AND, do NOT let any of the old guard / Paddy M, Heinie, or whoever be involved.

While I do agree that it takes too long and that certain national federations tend to protect rather than investigate their riders, I believe ALAD also carries out doping controls of foreign athletes at international sporting events taking place in Luxembourg (not only national athletes)

The actual President of Luxembourg Olympic committee was on the ALAD panel that screened Schleck the first time. I'm not implying any conflict of interest, but he surely knows the impact of the decision taken back then of clearing Schleck. I yhink the reason of ALAD to acquit him was "lack of proof".

This time around, exactly the same will happen, they just waiting for December to arrive, when Joe Public will be buying Christmas presents.

ALAD is not rich, and won't take the risk of condemning FS. Schleck's lawyer could attack them on court.

They will do a "Contador", waiting as long they can with a decision, and letting him go, with the hope (or rather certainty) that UCI will bring up the case to CAS.

What's an interesting detail in this case is that the UCI got involved right from the start (there was a UCI representative present at the first hearing). So maybe there will be less time between the verdict and the appeal of the UCI

I thought he was only investigated and cleared for the Puerto rather than faced a tribunal hearing and won, the two are quite different. An investigation can be re-opened and an example was Basso. Once you face a tribunal hearing and win, you have won forever though.
 
What can we glean from Frank's expression?

What with all the recent pathetic 3 and 6 month bans been handed out I suspect Schleck to get something similar and be ready to race the begining of 2013.

If this proves to be the case, then we can really forget about the peloton being clean due to the threat of hard scanctions:mad:

The bar is now very low. Everybody tries to drop it even lower.
6 months backdated ban for Schleck coming up.
These clever delay tactics will allow Schleck to participate in critical training camps and he will be ready for P-N.
