Interesting piece on Livestrong

"LIVESTRONG," and all the variants, are trademarks registered to The Lance Armstrong Foundation--even Livestrong.com.

That discovery is a mighty surprise to me. If Lance is making money off the Livestrong trademarks and the Foundation is allowing it, then things are really complicated. Is the Foundation abandoning its trademark by letting Lance use it? Does Lance sublicense the trademark from the Foundation? How does this affect the Foundation's nonprofit status?

Could get interesting.

Nothing here regarding the trademarks. Someone has to own those trademarks. The way I've personally seen it work is the owner agrees to a perpetual license of said trademark for the symbolic sum of $1 to meet basic contract law criteria in the U.S.

Now, is the .com/.org/wonderboy foundation an intentionally tangled mess by design? Of course. Is the fraud is bigger than whatever corruption binds Hein and Pat to Wonderboy to this day? Maybe.

Just understand that the 501c3 thing is ripe for exploit and that's what Wonderboy's people have done.

Giving the trademark use away for less than fair market value to a profitmaking entity is one of the things I'm wondering about.

There are lots of legal ways to spin licensing the trademark. There is no crime for inentionally or otherwise doing what you may view as a bad deal.

If there are regulatory problems sufficient to bring some sort of regulator action, they are buried in the tangled mess that is the .org/.com scams.

And then there's the simple fact the regulators have already been bought at least once, so I'm sure there's a price for keeping regulators away from the .com/.org scams.

If you want to work on something, figure out what still binds Wonderboy to Hein and Pat.

Don't worry, MarkvW. By this time next year, the Livestrong Foundation will be shutting its' doors forever.

I say two months, and I'm willing to put a tenner (£10) on it.

There I was, reading the article on WADA increasing suspensions. Just when I was thinking that this could be cited this as the Armstrong rule - after all, Floyd has his rule - one ad jumped right out at me:

LIVESTRONG

WEAR YELLOW

Since 2004 NIKE has helped the
Lance Armstrong Foundation raise over
$80,000,000 to help fight cancer.

It rotates to promote

2012 Cycling Gear available now.

Yup, the Nike Swoosh still supporting Lance, and Livestrong inherently defined as Lance.

And, since advertising must generate a return, apparently this site is a fine place to keep selling all kinds of Lance memorabilia.

On Cnn airing Thusday LA states what will happen to Livestrong.

Sport Illustrated, the publication that named him Sportsman of the Year has now rescinded that distinction and replaced it with "Turkey of the Year". So, unless Lance is preparing to admit his guilt/fraud, ongoing IRS concerns over foundation funds misusage or a general acknowledgement of his irrelevancy; what could he tell us we don't already know? That it's going to be called the Greg Lemond/Betsey Andreu/Floyd Landis foundation?

fire sale

Selena Roberts mentioned an IRS investigation (audit?). The WSJ mentioned Ms. Roberts' story. Have there been any other stories on the issue with a source other than Ms. Roberts?

Have there been any stories on the morale of Livestrong workers?

Well, here is a positive spinoff of LA and Livestrong, so to speak. Head coach Chuck Pagano of the Indianapolis Colts (American football team) has leukemia. In solidarity, some of the players and cheerleaders had their heads shaved, and a campaign known as ChuckStrong is raising money for research.

Local Great Clips salons are donating $10 to "Blue's ChuckStrong Challenge" for every person who agrees to have their heads shaved. 800 fans have had their heads shaved so far, and more than $250,000 has been raised for leukemia research by Colts representatives since the "ChuckStrong" campaign began.

Interesting that they don't have a problem with associating themselves, however indirectly, with Livestrong.

How soon before they are sued for trademark infringement?

That was my first thought, but then my second was is there any money still being spent on such things as there is little money coming in so they need to minimise outgoings.

I wonder will it be down or up this year?

Livestrong is on a slippery slope as it was built on the image of a fraud so why use what must now be limited resources(dwindling donations) fighting for a lost cause.

One thing about owning a Trademark is you must defend it or else run the risk of the courts saying the mark is unenforceable if a situation came up that ever really mattered. Let's say American Cancer Society starts a "curestrong" campaign.

Someone has to send the letter to the Colt's office.

Here is my favorite part of that article:

"Correction: January 13, 2013

A previous version of this article incorrectly stated the period of time over which Capital Sports & Entertainment, the company headed by Armstrong’s agent, earned $423,000 in fees from Livestrong, based on the partnerships the firm generated. Capital Sports made that amount in fees over three years, not two.
"

Pretty good fee generation, even if it was stretched over another year.
