The dispute essentially centres on Kimmage repeating statements of Landis that Armstrong had said to him he had sent money for them to cover up positive tests - ie an allegation of corruption.

The duo sued Kimmage and Landis (noticeably not the publications in which the allegations were made - which is below the belt). Hamilton confirmed as much , so Kimmage can now point to two sources as therefore being responsible journalism in public interest. How "responsible journalism" and "public interest" figures as a defence in swiss defamation, I do not know.

I think you will find there are a host of statements and actions by Pat & Hein that support the notion of suspected corruption by them at UCI.

Then there are statements and actions by Pat & Hein that are defamatory to Kimmage and others, including taking out the defamation case, then suspending it, as well as very recent ones (eg "scumbags").

So there will be no shortage of hanging out the dirty washing on the leadership of our sport.

Agree Absolutely. I was just answering someone who asked for one specific example statement that Kimmage had mande that the disgraceful duo allleged as defamatory.

“It’s justice for the kids who came into the sport and thought they had a chance of achieving their dreams but ended up in coffins; justice for all the kids who wanted to achieve their dreams without doping and were forced out of the sport because they didn’t have a shot and justice for those that were left with a choice, cheat or be cheated.”

Very poignant statement form Kimmage, seems his passion has really been arroused by these two clowns, appears his stand point is a moral not financial one. Couldnt happen to two nicer blokes..........;)

I believe the children are our future.

"It's justice for Landis and all the others silenced" the only justice for Landis involves a lot of rat poison, and a punch in the balls from everyone that donated to his lies

Although that sequence of events sounds correct to me it doesn't sound strikingly defamatory (ie, McQ + V deny Kimmage's claims of corruption and then sue Kimmage). It's not like calling whistleblowers "scumbags" in a press conference.

So maybe UCI/McQ +V have not made defamatory statements about Kimmage. I've done a little searching but haven't turned up anything.

Absolutely. Teach them well and let them lead the way.

Completely agree.

Show them all the beauty they possess inside. Give them a sense of pride to make it easier. Let the children's laughter remind us how we used to be.

I also think that everybody's searching for a hero, people need someone to look up to.

Well, I don't think they will find one in Whitney Houston.

Special words Hog.... I feel quite emotional! I feel as emotional as Lance when he opens his Lawyers bills :)

I never read it, and don't plan to. If they have enough evidence they should sue Pat and Hein, then. Why this attntion-whoring s**t storm? I just don't like loudmouths

So, all those attention seeking victims of sexual abuse at the hands of the Catholic Church should just shut their mouths, because they're whiners?

Is that right your holiness?

Hope we see his evidence (afffidavits) showing Paddy told riders to keep quiet when USADA came calling.

If Kimmage had evidence of that he would have published it earlier. I doubt there's anything in Kimmage's filing with the police that isn't already public knowledge

You forget the file Greg LeMond has.

I bet that a lot of people in the sport approached Kimmage with their evidence of UCI refusing to do anything about doping when they spoke out.

Hurrah for PAUL ! Whilst Paul would have preferred to fade into the background , the " prats of Aigle " chose to " Suspend their action " , thus causing greater anxiety and stress for Paul !

Now that the Swiss Police are involved , i feel sure they will want to see that their National Honour is not damaged by an Irishman , unable to represent his country at the Olympics and a Dutchman , who thinks he is THE Master Puppeteer !

When the Swiss Police scrutinize the info presented to them by Paul's Team , they will act with alacrity , to show the World that Switzerland does not condone the antics of the " prats "!

Mc Quaid family seems to be accident prone at present with , Andrew looking foolish for trying to take down Greg LeMond and " phat " following heinous's lead in attacking an unemployed Journalist !

Week of 5th November the " UCI Management " is supposed to announce the " External Investigation details ", lets hope that , that announcement includes the " standing down of phat & heinous until after the Swiss Police conclude their investigation ?

UCI should NO LONGER be paying the legal fees that this dubious duo generate !

“ UCI Buildings “ containing Offices , Sports Centre , Museum & Velodrome , is not on property in Aigle . It is several kms from city Centre , but as it is at the exit from the “ Autobahn “ , could be considered just as valuable . Regardless of whoever owns the land or buildings , this is a prestigious situation and well worth the effort to visit when in the locality . Seems to me that the resources are fully utilised 7/24/365 by both Local and International bodies . On the transit from the “ Dauphine Libere this year , to the Tour de Suisse , I took the time to call in and watch some training on the Sunday Afternoon . Complete contrast from talking to Brad Wiggins & Cadel Evans in France and talking to Ladies in a Local/Canton Amateur team on their track bikes . Storage there of bikes , also for “ International Teams and those sent there on Scholarships .

Those working in the “ UCI Team “ , do not deserve to be “ tarred with the same brush “ that the “ phats of aigle “ are so overdue ! No doubt there are everyday Swiss Cyclists contributing to the “ Paul Fund “! Whilst the “ UCI “ are based in Aigle , and the Local Swiss would be happy tht they contribute to the local economy , I doubt that they are aware of the damage , “ the phat duo “ are doing to their Country’s proud reputation ?

Should Paul and his team have access to documentation that establishes “ Fraudulent behaviour “ then Swiss Police at Canton or National Level will choose to act , since the perpetrators are Foreign Nationals . Reports of release of terms of Reference for the “ External Investigation “ in the week of 5th Nov , will I hope , include the “ UCI Management “ deciding that the “ phat duo “ are to step down from their “ duties “ during the period of investigation ? Lets hope there are those in the “ UCI “ that can enforce this action !

Congrats to Paul for forming a Team that includes those with “ Street Smarts “! He was right in saying he would “ Unleash Hell on the “ UCI Management “!

Thanks, that was me, but I was actually wondering the reverse. Are there any specific statements that the 'disgraceful duo' have made that might be defamatory to Kimmage? Was wondering if defamation might be one of the possible charges Kimmage is asking the police to investigate. However, I haven't been able to find any striking examples.

In contributing to the Kimmage fund, I do not think I signed up for this!
Agressive rather than defensive action.

I'm not buying it. You've been trolling this board for the past month.

It is in no way believable that you have contributed to that fund.

What is so amazing is that it was the UCI that started court actions....what planet are they on?

Pat and Hein were taken on a private spaceship to Planet Lance. On Planet Lance, liars sue truth-tellers for libel, and win, over and over and over again. Liars always get away with lying, and those who tell the truth repeatedly lose libel and defamation suits or are forced to settle. On Planet Lance, Pat and Hein drank lots of the Kool-Aid. When they returned to Earth, they didn't realize that the Planet Lance Constitution didn't apply on Earth. Their lawsuit against Landis succeeded, mostly because Landis didn't care, and so they thought the Law of Lance was indeed operational and they could continue to lie, and win lawsuits. So they sued Kimmage. And then Star Destroyer Travis pulverized Planet Lance. Now Pat and Hein are trying to understand how Earthling truth and justice works.

Well from the interview Paul sounds confident that Cedric Aguet thinks they have a strong case to present.

Excellent news.
