Can't see where it was brought up but, why on earth would he carry her downstairs after shooting her? That makes absolutely no sense at all. She was still alive he claims, should have called ambulance straight away and not move her. I think he was deliberately disturbing the crime scene. Guy is so guilty.

Well, he could have shot her when she was asleep, with something under her head to soak up the blood, which he later flushed down the toilet. I'll admit I don't like that scenario, though, because it doesn't fit a crime of passion, of one moment of rage. But another variation that avoids both problems is that he followed her to the toilet, got there before she could lock the door, and shot her once point blank. Then he set up the scene shooting through the door to make it look like he thought she was an intruder.

Also I'm fairly sure you can tell if a wound was pre- or postmortem. If he shot he after she died the autopsy would show that.

He said she was still alive when he broke down the door. Whether that is true or not, people who suffer a mortal gunshot wound frequently do not die immediately, but after a period of minutes or hours. The idea is he could have effectively ended her life with one shot, yet her vital functions remained for some time afterward, so one could not tell the timing of subsequent gunshot wounds.

Boy, Desmond Nair loves the sound of his own voice, doesn't he? If he takes this long to announce a decision on bail,how many weeks will it take for him to announce a decision on the actual case?

Seems to me he has a lot to lose by hanging around if he gets out on bail, and not a lot to gain. No matter the decision, his athletic career, fame and sponsors seems over.

Does he wear shoes? He certainly doesn't on his blades. Also, bullet casings are pretty large. I have big feet and I still don't think a casing would lodge in my footwear treads.

Speculation is fine, but that sounds ridiculously implausible.

In my defense i stated my opinion before he said all those. but let's see.

After listening to most of the ruling (2hours and the last couple of mins were cut off due to i'm a guessing a surge on the website) I'm not sure i completely understood how the judge granted bail.
He seemed to reinforce that despite some inept police work and testimony it had to be schedule 6 (pre-meditated murder charge). I thought therefore the burden was on the defence to provide exceptional circumstances to grant bail.

It wasn't clear to me that they did. In his summarisation the judge appeared to indicate the opposite; that the prosecution had not proved any of the conditions why he couldn't grant bail (flight risk, repeat offences, tampering with evidence/witnesses etc.) which to be fair they hadn't. But as i said i thought the burden was on the defence to provide exceptional reasons why he should get bail not just prove he wasn't a flight risk etc.

Just before the commentary cut off the judge seemed to be saying that the sworn affidavit of OP was the exceptional reason for granting bail but then it cut off and I'm at a bit of loss to see how the affidavit of OP was reason for granting bail ??
 
During the last half an hour of the so called judge reasoned decision , I had the feeling that bail was not going to be granted . So it came as a surprise when bail was granted and the extremely low amount ($28,000) of the bail .

After hearing both sides judge Nair left the courtroom at about 12:00 , to have lunch and make up his mind .
"I'm now in the unenviable position," of having to decide... at 14:30.

At 14:30 , that is 2 and a half hour after the recess was called he came back with his decision , a long winded decision , a thorough one .

It took him 1 hr and 40' to go through the whole statement , cited a lot of jurisprudence to give it more weight .

In my opinion , to make such an elaborated statement , with research and transcription , may take way over 5 hours .

Nevertheless , he got it in 2 and a half hrs , lunch included .

In my opinion , this elaborated statement was done beforehand .

A prime example of premeditation .

This may seem like a victory for the defense, but I believe the prosecution, by charging premeditated murder, won something critical. Pistorius was forced to provide that affidavit, which really pins him down. He can't change his story now. As has been well discussed here, there are a lot of very difficult things for him to explain.

Given more time, OP's team probably could have constructed a story that made a little more sense (e.g., didn't scream at the intruder because didn't want the latter to know he was awake and coming for him; felt the bed very quickly and thought she was there, but it turned out to be bunched up covers). Now the phoniness of the story is out there for everyone to see.

I can't see OP avoiding some jail time, and I don't see how his career and his endorsements can continue after this. He may not get what a lot of people think he deserves, but I think he will pay considerably for this.
