I'm not saying it does. The rules are based on the same legal framework and how sports law and the rules that determine it get applied. Strict liability, look it up.
What does happen though is UCI, race comms and the jury have discretion on applying their own rules or not ie they don't have to, even though they're written down. We see that balance all the time and think that will happen here with a fine only which was brought in in Januarys rules.

No. UCI can't fine Pogi in this case and if by any chance they would try to, then Pogi can still take them to CAS and win.

UCI is going to find out just how marginal bike racing really is.. Comedy writers couldn't come up with better material!! Rider and race organization at odds with the governing body that gave us the Lance Armstrong conundrum!! It's beyond unbelievable that anyone at the UCI would come out in public about the best racer in the sport wearing an objectionable and inappropriate shade of pink!! You can't make this stuff up!! We will work on doping and getting riders paid but first, that's not the authorized pink!!!

And the UCI clearly has no fashion sense, the real issue here! I mean, pink top and pink bottom is vomitevole! Leave Italy decide the appropriate color match, which, by the way, they did a fine job with here (a nice cangiantismo worthy of a Michelangelo sibyl). Those UCI officials know nothing about style!
