Will Bert be banned or cleared?

  • I'm uncertain what the outcome will be.

No, taking away the title means he had an unfair advantage over his competitors, willingly or not.

Isnt an advantage usually unfair? The year before Contador had an unfair advantage over Schleck with the ttt. He has an unfair advantage over lots of people by being more talented, or by being born with the right physicality to be a top climber etc etc etc.

The levels of clen they found are not performance enhancing, though, right?
Right, but I'm not sure the rules make room for that kind of thing.

It's not comparable at all. We're talking about anti-doping stuff here.

Unlike positive, talent, hard work and so on can not be evaluated objectively.

This cannot be proved, or disproved, unless you can invent a time machine, go back in time, and ensure all competitiors ran clean. Then compare results.

Anything else is pure speculation, and is subject to the bias of the interested party.

He has to lose the title, even if they dont ban him.
What if a gc guy gets during a tv interview at the Tour attacked by a guy with a needle full of EPO?He has the proof that he didnt put the stuff into his body so he wouldnt get a ban but would he be allowed to continue? No.
If Contador is indeed innocent, he can sue some spanish farmers but he cant keep his title.

Understand what you are driving at. If AC was found on balance of probabilities/likelihoods not to have deliberate doped. And iff the decision included the finding that the Clenbuterol provided an ergogenic aid... then a recommendation to anull his Tour win is significant possibility.

However the amount of Clenbuterol detected is, of itself unlikely to be regarded as an ergogenic aid. Therefore if AC is found to have no negligence I think he will keep his 2010 TdF title.
