If you believe Mr. Brown (a big if), Ms. Cohen and Mr. Brown agreed that Mr. Brown would be responsible for the fund. This would have effectively taken the fund out of the Brown v. Cohen lawsuit, but for Mr. Hue's intervention.
Mr. Hue is now going to ask the Court to order Brown to deposit the money with the Court. Brown has no rational reason in the world to fight this and no legitimate objection to doing it.
If Brown wants to object, then Mr. Hue just might request a factual hearing on the matter, where both sides can present evidence--and where Mr. Brown can be cross-examined. If the judge smells a rat, then that kind of a hearing seems possible. It would also mean that Mr. Brown would have to bring his sorry self back to the USA where he would be easily subject to service of process.
My guess is that if Brown doesn't deposit the money with the Court when Mr. Hue asks, then the money is gone. . ..
