The whole thing is unfortunate. Bad business dealings happen.

Poor Lesli is having to hire an attorney and deal with the emotional toll that usually comes with litigation. No fun but it sounds like she has no choice.
She definitely seems like a trusting person who may or may not (need more info) have gotten taken advantage of.

Paul is probably embarrassed...he didn't want to take the $ in the first place...now he is in the center of some stupid articles that have been written and @sshole comments...he's done nothing wrong.

Hopefully this gets resolved quickly.

i am really truly disgusted with this all.

Digger should be commended for starting this all up.

Andy for stepping up to the plate and helping out.

and, of course, the lovely Lesli who did nothing f*cking wrong except, perhaps, trust the wrong person.

she, like the two mentioned above, did this to help try to right a wrong -- exactly what all of us that did contribute tried to do as well.

all are blameless, most especially the man this fund was set up for -- Paul Kimmage. Paul, who never even asked for this, was gobsmacked by the support, and heartened to continue the fight -- by Digger, Andy, Lesli, and all of us.

people who question why this came out in press and why it was so sloppily done. i can't say much about the quality of reporting, but i think it may have come out to try and press the rogue in Girona to come clean.

i believe in the fund i donated to more than once and pushed others to do as well. i believe in the good intentions by Digger, Andy, and Lesli. and i believe in the man the fund was set up for, Paul Kimmage.

i would donate again.

That's pretty much my thinking too. We wouldn't have reached this stage if there was an ''innocent'' explanation behind it.

I'm sure that's the case but it was pretty daft that Brown was left as the only person with access to nearly $100,000. From the little I know about him (Brown), he strikes me as a complete oddball.

And yes I did make a donation.

I donated, and so far I have no problem with all this. Maybe there's some fraud, but I see no evidence of it at this point. It seems to me there were two mistakes made so far:
1. Setting up the fund in haste in the first place without considering any possible tax implications. Perhaps there is still a work-around. But if not, there will be some funds wasted to cover this, and it would seem reasonable to hold some back for that purpose. Too bad. **** happens. At least they meant well.
2. Someone filed a pre-emptive lawsuit, making all this public record, before simply sorting it all out. This indicates a serious lack of trust, and possibly a bitter business break-up, between the Cyclismas parties. Someone played hardball filing the lawsuit, and the other doesn't appear to trust that person enough simply to hand over the money without assurance that the tax liability is covered. This is totally normal when lawsuits are filed - people get p i s s y.

Filing a lawsuit is flat-out dirty pool and stupidity if it turns out that there is an innocent explanation as above. It is a scorch-the-earth tactic that undermines the credibility of the entire venture. A PR disaster - who wants to listen to Fran F***ing Millar gloating? Who the **** is advising these people?

It strikes me as highly unlikely that someone who posted in the manner of "UCI Overlord" would immediately turn around and be guilty of the same crimes he stood against so publicly, all over a measly $10,000. On the other hand I only read a few of his posts and maybe I have too accepting a view of human nature.

I would donate again if necessary. :D

Always was strange that UCI overlord person, seemed to be a self promoter and not really know much about cycling, like a lot of the big twitter blowhards. His articles in 2r magazine are embarrassing and I hope he goes away.

For taking a shot at Brown after he's been on Sky's case about a lack of transparency etc? I'd say that's a pretty normal reaction in the circumstances.

I'm not willing to forgive her so easily, but I see that she, as a PR person likely with a bit of disaster-control experience, at least has the common sense to correct her first impression.

As the fund was not set up non-profit, the money went directly into Brown's bank account. It was a gift from the donors

Gift tax is pretty clear in the US, the first $11,000 per donor is tax free. The means the only taxes would be if some person gave more then $11,000 and then the tax would be paid by the Donor, not by Brown. What is he concerned about?

This sums it up very well. We do not know the full story yet and Cyclingnews handling of it with words such as "missing" "disappeared" is decidedly tabloid.

The money went into a fund, Brown has access, solicitor paid from that fund. There is no reason for either Kimmage or the solicitor to have access to that fund, in fact, for fairly obvious reasons it is better that they don't.

I'm sure over the next few days the full story will come out and everyones mind will be at rest. In the meantime CN have done a good job of "outing" a twitter pseudonym.
