In this forum several LA fanboys have cited his charity work as being a "defense".

I have put up this example to demonstrate in the real judicial world his charity work will only surface during submissions for sentencing after he has been convicted.

Rajaratnam from his "cheating" only made a modest profit of $7.4m. What profit did LA make and is still earning if it is concluded he cheated? Endorsement income @ est $20m pa.

There are more dangerous health risks associated with the "cheating" procedures of PED users than putting in buy and sell orders with your broker.

this falls right in with his decision to cancel the 'Brazil trip' for 'personal reasons' doesn't it?

Legally you are correct. With insider trading there is no clear direct victim, if any victim at all.

It is believed, but not proven, that enforcement of insider trading laws may reduce the costs of securities.

Insider trading laws are only enforceable against persons who profit who are in a position that they owe a fiduciary duty to shareholders of the company in whose securities the insider is dabbling.

However, fact is that persons do obtain non public information that can be used for share profit making without being in a fiduciary position.

I'm waiting for this day, too. But we'll have to see who rallies around Armstrong once the indictments become public knowledge.

Right now the fanboys seem to be in hibernation seeing as Armstrong doesn't race anymore.

I imagine they will come out spewing the same vitriol they did when Greg Lemond had the audacity to question his association with Dr. Ferrari. On Greg's bicycle forum (when his brand was affiliated with Trek, if I'm not mistaken) he got absolutely skewered. I'd never seen anything like it in my life.

I wonder if any of those toolbags would have the decency to post an apology now that the day of reckoning is coming ever so closer for Dopestrong.

Again I'm not into criminal law but only the new zealand tax law but if you want my opinion with the little knowledge I have of criminal law I would say that it would be hard to condemn Bin Laden when it comes to 9/11. When I say he's guilty as sin it's because he's admitted so many other acts of terrorism that we would have sufficient evidence to condemn him anyway. The video of Bin Laden admitting 9/11 is probably fake, so it wont hold up. But I'm not sure on Lance. I think he might have to admitted to doping on tape. I think Floyd have taped a phone call. I'm not sure.

That is sure a long list of 'random ideas'. Quantity vs quality...I'll leave that up to Novitsky, the FBI, Interpol, the innumerable swore testimonies and the national and international Cancer Foundations that will immediately bolt from any association with LAF. Magazines will be sold as the stories unfold, and the handcuffs wear cold.

If the choice was between spitting up blood with cancer spreading in my brain and lungs or facing 20 Federal Indictments of the caliber facing Lance, I would choose the indictments of course.

Raj is just one of countless guys that did the same thing. This is absolutely a case of him being the public example. He's the fall guy for his superiors. Further up the chain far worse was and is still happening. Even among his peers it's still going on. Armstrong's case is different. Athletics is outside the beltway stuff. I can't predict how his crimes would play in Congress with Fabiani likely trying to close the case with Congressional influence.

As for insider trading being victimless. Absolutely wrong. I'm a victim. Anyone with a 401k is a victim. It's stealing.
